Terms of Service

These terms are an agreement between you and OMOX Ltd(“flyWilco”, “we”, “us”) and govern your use of the flyWilco website and booking application (the “Service”). By creating an account or using the Service, you agree to these terms.

1. The Service

flyWilco provides booking, scheduling, approvals, member management and related tools for flying schools and non-commercial flying groups. We may add, change or remove features over time.

2. Accounts & eligibility

To open a flyWilco account for a school or group, or to subscribe to a paid plan, you must be at least 18 and able to enter into a contract. Members aged 16 or 17 may use flyWilco, including the mobile app, when their school or group adds them; the school or group is responsible for any consent it needs from a parent or guardian. You are responsible for the accuracy of the information you provide, for keeping your password secure, and for all activity under your account. You are responsible for your members’ access and for having a lawful basis to add their data.

3. Acceptable use

You agree not to misuse the Service: no unlawful, harmful or infringing activity, no attempts to break security or access data you’re not entitled to, and no reselling the Service without our agreement.

4. Plans, billing & VAT

• The Free plan is provided at no charge, subject to its limits.
• Paid plans (Club, School) are billed monthly or annually in advance via Stripe. Prices shown include VAT at the prevailing UK rate; a VAT invoice is issued for each payment.
• You can cancel at any time from the billing portal. Cancellation takes effect at the end of the current billing period; you keep access until then and are not charged again.
• Except where required by law, fees already paid are non-refundable. If we materially reduce a paid feature you rely on, contact us and we’ll deal with it fairly.
• If a payment fails, we may suspend paid features until it is resolved.

5. Plans and fair use

• Each plan’s limits (for example the number of aircraft, instructors and members) are as shown on our pricing page at the time. If your organisation is over a limit, for instance after moving to a smaller plan, you keep everything you already have but can’t add more until you’re back within it or upgrade.
• The Club plan is for non-commercial clubs and groups. Commercial training, including training delivered by an approved or declared training organisation (ATO or DTO), or paid instruction run as a business, requires the School plan.
• Founding School price: schools that subscribe to the School plan while our founding-school offer is shown get the founding School price. It continues for as long as that subscription stays active, and ends only if the subscription is cancelled or lapses, after which the standard School price applies. A school can switch between monthly and annual billing and keep its founding price by asking us to make the change. Changes in the rate of VAT still apply to the founding price. We may end the offer for new sign-ups at any time.

6. Your data

You retain ownership of the data you put into the Service. You grant us the limited rights needed to host and operate the Service for you. Our handling of personal data is described in our Privacy Policy. You can export or delete your data as described there.

7. Availability

We work hard to keep the Service available and accurate, but it is provided “as is” without warranties of any kind. Weather and other third-party information is for situational awareness only and must not be relied on for flight planning; always obtain an official pre-flight briefing.

8. Intellectual property

The Service, including its software, design and branding, is owned by flyWilco and protected by law. These terms don’t transfer any of our intellectual property to you.

9. Limitation of liability

To the fullest extent permitted by law, flyWilco is not liable for indirect or consequential losses, or for loss of profit, data or goodwill. Our total liability in any 12-month period is limited to the amount you paid us in that period. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these terms or to protect the Service or other users.

11. Governing law

These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of its courts.

12. Changes

We may update these terms; the date above shows when. Continued use after a change means you accept the updated terms.
